If you do not have a valid will, or have an old will which has been made out of date, please continue reading below.

Without a valid will, your assets may not pass as intended.  Property would not pass to unmarried partners (including civil partnerships), friends or favoured charities.


If you have no family, your assets will pass to the government, which is a 100% tax rate on everything you have earned during your life.


Marriages revoke existing wills, so your estate would be administered as if you do not have a will.


A divorce will not allow for the ex-spouse to be an executor of the will or receive any gift from the estate

Why have a power of attorney (PoA)?

This legal document allows you to appoint one or more people to make decisions on your behalf.


There is no automatic right for your next of kin to access bank accounts etc.

How can act for me?

This can be friends and/or family.  They would be involved in signing the paperwork.


You can appoint more than one person who can act on their own or jointly with others.

Types of PoA

There is a property and finance plus a separate health and welfare.


You can complete one or both.


The property and finance document allows your nominated people to sell your property, access and withdraw money from your bank accounts, sign documents, make purchases.


The health and welfare document allows your nominated people to make decisions about your medical care or where you live.

Is there anything else I should consider?

A PoA cannot be made if you lack mental capacity or have dementia. 


If you do not set up a PoA and it becomes necessary due to someone losing mental capacity, you can apply to the courts but this is very slow and costly.


Once the document has been signed, you can keep it safe until is required.  This would require registration with the Office of the Public Guardian.

You will deal with the owner of the business, Adrian Metson. 


You will not be assigned to a more junior member of staff at a later date.
